These Terms of Use govern your access to and use of the baqegoo platform, including all content, features, and services made available at baqegoo.pro. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
Platform refers to the baqegoo website, web application, and all associated digital services operated under the domain baqegoo.pro.
User refers to any individual who accesses, browses, registers on, or otherwise interacts with the Platform.
Account refers to the registered profile created by a User to access restricted features and purchased content.
Content refers to all text, video, audio, images, course materials, downloadable files, and any other material made available through the Platform.
Subscription refers to a recurring or one-time paid access plan that grants a User access to specific Content or features.
2. Eligibility
You must be at least 18 years of age to create an Account and use the Platform independently. Users between the ages of 13 and 17 may use the Platform only with verifiable consent and active supervision of a parent or legal guardian, who assumes full responsibility for the minor's activity.
By using the Platform, you represent and warrant that all information you provide during registration is accurate, current, and complete. You agree to update your information promptly if it changes.
3. Account Registration and Security
3.1 Registration
Certain features of the Platform require you to register for an Account. You agree to provide truthful and complete information during registration and to keep your Account information up to date.
3.2 Credentials
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your username or password with any third party. Any activity conducted through your Account is your responsibility, whether or not you authorized it.
3.3 Unauthorized Access
You must notify us immediately at [email protected] if you become aware of any unauthorized use of your Account or any other security breach. We will not be liable for any loss resulting from unauthorized use of your Account that occurs before you notify us.
3.4 Account Termination by User
You may close your Account at any time by contacting us at [email protected]. Closing your Account does not automatically entitle you to a refund of any fees paid.
4. Permitted Use
You may use the Platform solely for lawful, personal, and non-commercial educational purposes. You agree not to:
a) Copy, reproduce, distribute, publicly display, or create derivative works from any Content without prior written authorization;
b) Use automated tools, bots, scrapers, or data mining software to access or collect Content;
c) Attempt to reverse engineer, decompile, or otherwise extract source code from any part of the Platform;
d) Circumvent, disable, or interfere with any technical protection measures applied to the Platform or Content;
e) Use the Platform to transmit unsolicited communications, spam, or malicious code;
f) Impersonate any person or entity or misrepresent your affiliation with any person or entity;
g) Use the Platform in any manner that could damage, overburden, or impair its infrastructure or interfere with other users' access.
5. Intellectual Property
5.1 Ownership
All Content, trademarks, logos, trade names, and intellectual property available on or through the Platform are owned by or licensed to baqegoo. Nothing in these Terms grants you any ownership interest in such materials.
5.2 Limited License
Subject to your compliance with these Terms and payment of any applicable fees, baqegoo grants you a limited, non-exclusive, non-transferable, revocable license to access and view purchased Content solely for your personal, non-commercial educational use during the period your access is active.
5.3 Restrictions
You may not sublicense, sell, resell, transfer, assign, or otherwise exploit the Content or your access rights. You may not record, capture, or reproduce video or audio Content by any means without explicit written consent from baqegoo.
5.4 User-Submitted Content
If you submit any content to the Platform, including comments, feedback, or project files, you grant baqegoo a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display that content for the purpose of operating and improving the Platform. You represent that you have all necessary rights to grant this license.
6. Payments and Subscriptions
6.1 Fees
Access to certain Content requires payment of fees as described on the relevant purchase pages. All fees are stated inclusive or exclusive of applicable taxes as indicated at checkout. You are responsible for any taxes applicable to your purchase.
6.2 Billing
For subscription plans, your chosen payment method will be charged automatically at the start of each billing cycle. You authorize baqegoo to charge your payment method for all fees incurred under your Account.
6.3 Price Changes
baqegoo reserves the right to modify pricing at any time. For active subscriptions, price changes will take effect at the start of the next billing cycle following reasonable notice.
6.4 Refunds
All sales are final unless otherwise stated at the point of purchase or required by applicable law. If you believe you are entitled to a refund, contact us at [email protected] within 14 days of your purchase with a description of the issue.
6.5 Failed Payments
If a payment fails, your access to paid Content may be suspended until payment is successfully processed. baqegoo reserves the right to terminate your Account after repeated failed payment attempts.
7. Third-Party Services and Links
The Platform may contain links to or integrations with third-party websites, tools, or services. These are provided for convenience only. baqegoo does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party service. Your interactions with third-party services are governed solely by their respective terms and policies.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
9. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. baqegoo expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
baqegoo does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. baqegoo does not warrant that any Content is accurate, complete, or up to date, or that the skills or techniques taught will produce any specific result for any specific User.
10. Limitation of Liability
To the fullest extent permitted by applicable law, baqegoo and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Platform or Content.
In no event shall baqegoo's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of: (a) the total fees paid by you to baqegoo in the twelve months preceding the claim, or (b) one hundred euros (€100).
11. Indemnification
You agree to indemnify, defend, and hold harmless baqegoo and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.
12. Modifications to the Platform and Terms
12.1 Platform Changes
baqegoo reserves the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice. baqegoo shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
12.2 Terms Changes
baqegoo may revise these Terms at any time. When changes are made, the updated Terms will be posted on the Platform with a revised "Last Updated" date. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
13. Termination
baqegoo reserves the right to suspend or terminate your Account and access to the Platform at any time, with or without notice, for conduct that baqegoo determines, in its sole discretion, violates these Terms or is harmful to other users, baqegoo, third parties, or the integrity of the Platform.
Upon termination, your right to access the Platform and any Content will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5, 9, 10, 11, and 14.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with generally accepted principles of international commercial law, without regard to any specific jurisdiction's conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or the courts having competent jurisdiction over the matter.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or agreements expressly incorporated by reference, constitute the entire agreement between you and baqegoo with respect to your use of the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.
